Insurance Disputes
Indemnity disputes, property damage, liability claims, policy interpretation and settlement negotiations.
Introduction
Insurance disputes may concern whether a policy responds at all, how the wording should be read, or simply what a loss is worth. Behind the coverage argument there is usually a policyholder whose business or home has been affected and who feels the response has been too slow.
Subrogated recoveries, brokers' involvement and multiple layers of cover can make the negotiation more complicated than the underlying facts.
What we cover
- Indemnity and coverage disputes
- Property damage claims
- Liability claims
- Policy interpretation
- Settlement and quantum negotiations
Why mediation?
Coverage litigation is expensive and the outcome, particularly on wording, can be uncomfortably binary. Mediation allows a commercial resolution that neither side would obtain from a judgment.
It also separates the issues: coverage, causation and quantum can be dealt with in turn, and partial agreements reached along the way.
How ProMediate can help
We work regularly with insurers, brokers, loss adjusters and panel solicitors, and understand reserving, authority and reporting requirements. Days can be arranged to suit those constraints, including remotely.
We help policyholders understand how their claim is being assessed and help insurers hear what the policyholder actually needs, then focus on the practical terms — payment, reinstatement works, future cover and confidentiality.

The process is private and without prejudice. Nothing said in the mediation can be used later if the matter does not settle.

Frequently asked questions
- Can mediation resolve a pure policy interpretation issue?
- It frequently does, because the parties can agree a commercial outcome without needing a definitive ruling on the wording.
- Will the mediator have insurance experience?
- We will propose panel members with directly relevant coverage and claims experience.
- Can the mediation be held online?
- Yes. Insurance mediations work particularly well online, which also helps where parties and handlers are spread across the country.
